Contract and Booking

All the below terms and conditions are general and are applied for all products on oceanairtravels.com unless it has been mentioned on the product page itself.

A 'Customer' includes all the names on the booking form intending to travel with us. A 'Product' is any service sold by Your Choice Tourism LLC. All customers will be deemed to have read, understood and accepted all of our booking conditions. In order to confirm a booking, the agent must have full disclosure of all payments due. A contract between the customer and Your Choice Tourism LLC comes into existence once we have confirmed the booking in writing and issued a confirmation. The person signing the booking form (that incorporates these terms and conditions) warrants that they have full authority to do so on behalf of all whose name appears there-on and confirms that all such personnel are fully aware of and understand these terms and conditions. The said contract, including all respective matters, is subject to the law and the exclusive jurisdiction of the UAE courts. The company reserves all rights to decline any booking at their discretion without further explanation.

Your Choice Tourism reserves the right to make changes if required. Before a booking is confirmed, Your Choice Tourism reserves the right to amend the price of product due to any circumstances regarding external services not in control of Your Choice Tourism but not limited to changes relating to governmental action, increase in transportation costs (including schedule airfares and the cost of fuel) changes in any dues, taxes or fees chargeable for services (including landing taxes or embarkation/disembarkation fees at airports), increase in admission fees and hotel rate adjustments/availability. Advertised prices are also subject to seasonal changes, exchange rates and may vary slightly due to following conditions.

Your Choice Tourism (“we”, “us” or “our”) provides tours, safaris, transportation, international packages and other activities (“activities”, “activity”) to participants (“you” or “your”) either itself or through its suppliers.

1. Payment: Full payment is a must while booking. We reserve the rights to cancel the booking if the full payment has not been received 2 days prior to the commencement of the activity. The payment can only be made in the local currency i.e AED

2. Acceptance: We accept Visa and MasterCard payments on the website.

3. Delivery: Upon completion of the payment our team will revert you with a confirmation email within a period of 24 hours. This email can be carried as proof for the booking to us or our suppliers. Failure to turn up in the designated location for an activity by the specified departure time shall be considered to be a last minute cancellation and we reserve the right to deny any refund requests in such cases.

4. Service: We are entitled to cancel or omit any part of an activity without notice at our sole discretion. This in particular may be due to the nature of activities chosen. Cancellations may result due to factors beyond our or our suppliers' control, such as the weather, accidents, sickness, governmental restrictions and other events of force majeure. In such events a full or partial refund may be given at our discretion.

5. Pricing: The pricing on the website has been provided in USD and you would be charged in the local currency i.e AED. Full payment can be made through the online booking channel and this would be reflected on your statement. Any discrepancies should be brought to light within 7 days of the transaction after which we would be unable to entertain any requests.

6. Refund Policy Refunds may not be processed after the purchase of timed tickets (such as Burj Khalifa Timed Tickets, Shows Tickets, etc.) and visa charges along with airline tickets. All the refunds of any transaction’s amount against any purchase through this website would be refunded to the original mode of payment. For other activities the below table would be used: * Refunds processed at any time will bear a service charge of AED 10 per transaction. * Cancellations made seven calendar days prior to the tour date Refund: 100% of booking amount * Cancellations made 4 - 7 days prior to the tour date: Refund: 50% of the booking amount * Cancellations made 72 hours prior to the tour date: Refund: 0% of the booking amount

7. Inclusions Unless specified otherwise, the prices quoted on the website are charged on a per person basis and do not include tips, passport / visa charges, travel insurance, food and beverages, accommodation, room service charges, and laundry. We do our best to update our website as soon as possible, but the rates published will be subject to change without prior notice due to unforeseen circumstances or circumstances out of our control which may include changes in government regulations, airfare fluctuations, or changes in transportation rates.

8. Liability You understand and accept the potential risks and hazards that can be involved in certain of the Activities. You take responsibility for ensuring that you are mentally and physically capable of participating in the particular Activity. Where we offer Activities provided by third parties, or issue you with a voucher entitling you to a ticket for an event, we act only as an agent for the operator of the activity concerned or the organizers of that event. The terms and conditions of the operator of the Activity or organizer of the event will apply to you and any refund will be subject to those terms and conditions. To the maximum extent permitted by law, we accept no responsibility for any damage, loss, accident, sickness, injury or death that you or anyone else may suffer or incur arising out of the Activities opted for. All personal effects are at your sole risk at all times during the Activity.

10. Disputes: In case of any disputes the law applicable would be based on the UAE Governing Law, The Website Policies and Terms & Conditions would be changed or updated occasionally to meet the requirements and standards. Therefore the Customers must be notified about these changes as well as the Payment Gateway Provider / Emirates NBD Bankx(x) x(x)

Changes of these General Terms of Business

The Terms of Business are subject to change without prior notice. The terms that are valid at the time of each booking shall apply. The Customer has no claim that future bookings be completed under existing conditions.

Cancellation Policy

Your Choice Tourism reserves the right to cancel any confirmed booking in any circumstances, however, Your Choice Tourism will not cancel a Guaranteed Departure Product except in the unusual circumstances of force majeure, defined here as war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, flight cancellation or any other external circumstances beyond the control of Your Choice Tourism. Compensation is not available if Your Choice Tourism is forced to cancel or in anyway change a tour due to force majeure but if Your Choice Tourism is unable to provide the tour booked, all payments received(less any insurance premiums paid) will be returned to the client or they will be offered an alternative date or holiday of comparable standards.

If you cancel the activity, the cancellation policy on the Your Choice Tourism voucher is authoritative. We advise the customer to carefully read the information on the Your Choice Tourism voucher to get the required information

If there is no cancellation policy stated on the Your Choice Tourism voucher or the product page, the following cancellation charges will be levied by the same for the respective services: If there is no show the day prior to the beginning of the activity; no refund will be made

Your Choice Tourism or the supplier can cancel the activity without adherence to the cancellation period if weather conditions, governmental actions, unforeseeable or unavoidable external circumstances endanger or make carrying out the activity impossible or substantially more difficult.

Exclusion

Your Choice Tourism has the right to refuse admittance or exclude you from any activity if you do not meet the eligibility requirements, or if your participation puts you or others at harm, or otherwise interferes with the proper conduct of the activity. In these cases, the price paid will not be refunded.

This is done under exclusion of any compensation for damages or other claims under what legal basis whatsoever (applies to all cancellation policies).

Other Conditions

To the maximum extent permitted by law, Your Choice Tourism accepts no responsibility for any damage, loss, accident, sickness, injury or death that you or anyone else may suffer or incur arising out of the activities and/or is in connection with your contract with us and/or the operator of any activities.

You are advised to have comprehensive travel and health insurance. All personal effects are at your sole risk at all times during the activities that are carried out. You should understand and accept the potential risks and hazards that can be involved in certain activities.

You take responsibility for ensuring that you are mentally and physically capable of participating in the particular activity. Further conditions or alternative rules can be found on the respective product pages.

Amendments and Cancellations by Clients

At the time of booking, the customer is required to provide us with full, correct names as they appear on your passport. Any changes made to the original booking are subject to availability, if the full payment has been received and/or a voucher has been issued.

All the refunds of any transaction amount against any purchase made through this website would be refunded to the original mode of payment.
